FluidSurveys Terms of Service

1. Additional Terms

1.1. Additional Terms. Your use of the FluidSurveys service (“FluidSurveys”) is governed by the SurveyMonkey Terms of Use at http://www.surveymonkey.com/mp/policy/terms-of-use (“TOU”) and the additional terms in these FluidSurveys Terms of Service (“FluidSurveys Terms”) (which shall prevail over the TOU to the extent of any conflict or inconsistency with the TOU). FluidSurveys is a “Service” under the TOU.

1.2. Acceptance. In order to use FluidSurveys, you must first agree to these FluidSurveys Terms. You indicate your agreement to these FluidSurveys Terms by clicking on a button indicating your acceptance of these FluidSurveys Terms, by executing a document that references them, or by using FluidSurveys.

2. Privacy

2.1. Privacy Statement. You consent to the handling of your data associated with FluidSurveys in accordance with the FluidSurveys Privacy Statement.

3. General

3.1. Contracting Entity. FluidSurveys is provided to you by SurveyMonkey Inc. if you are resident or have your principal place of business in the United States. Otherwise, FluidSurveys is provided to you by SurveyMonkey Europe.

If FluidSurveys is provided to you by SurveyMonkey Europe, the following provisions apply with respect to FluidSurveys:

• Contracting Entity. References to “SurveyMonkey”, “we”, “use”, and “our” in these FluidSurveys Terms are references to SurveyMonkey Europe, located at 2 Shelbourne Buildings, Second Floor, Shelbourne Road, Dublin 4, Ireland.

• Governing Law. These FluidSurveys Terms are governed by the laws of Ireland.

• Jurisdiction. Except if prohibited by applicable law, in relation to any legal action or proceedings to enforce these FluidSurveys Terms or arising out of or in connection with these FluidSurveys Terms, each party irrevocably submits to the exclusive jurisdiction of the courts of Ireland.
